General conditions of sale

All orders placed on the site are subject to these general terms and conditions of sale. Christopher Herriot reserves the right to adapt or modify these general conditions of sale at any time.

1. The Customer

This site is freely accessible to any natural person who is at least 18 years old and must have legal capacity or hold a parental authorisation to place an order on the site.

2. The Products

The Herriot Pipes site aims to sell pipes and accessories online. Christopher Herriot takes the utmost care in the accuracy and description of his products. However, it is possible that errors may appear on the site, which the customer recognises and accepts. If the case were to occur, the Customer may exercise his right of withdrawal (7 days) and be refunded at the price, provided that the object has not been used. The return shipping costs will be borne by the Customer. If the withdrawal period has passed, the Customer may contact the after-sales service to find a favourable outcome, if the case permits.

3. Personal space

The creation of a personal space is an essential prerequisite for any order on this site. To this end, the member will be invited to provide a certain amount of personal information. The member undertakes to provide accurate information under penalty of termination of the contract at the initiative of the publisher and deletion of the customer account. Christopher Herriot undertakes never to share a customer's personal information with a third party.

This space allows the customer or member to consult all their orders placed on the site and to track the delivery of said orders. Christopher Herriot reserves the exclusive right to delete the account of any member who has violated these terms and conditions (for example, when the member has knowingly provided erroneous information, or when it has been proven that the keyint is under 18 years of age).

When creating his personal space, the Customer is asked to choose a password. This password is the guarantee of confidentiality of the information contained in their personal space and the Internet user is therefore prohibited from transmitting it or communicating it to a third party. Otherwise, the site cannot be held responsible for unauthorised access to a member's account.

4. The Order

The order taking procedure is materialised by a succession of different steps that the Customer must follow to validate his order (choice of products, account creation or identification, choice of delivery address, choice of payment method and validation). The customer will have the opportunity, before definitively validating their order, to check the details of it and its total price on an order summary. He will be able to modify his order or possible errors if he wishes.

Product offers are within the limits of available stocks. Information on the availability of products is provided for information purposes at the time of ordering. However, if the product becomes unavailable after validation of the order, the Customer will be informed by email.

Christopher Herriot reserves the right to cancel or refuse the order of a Customer who has already had a dispute during a previous order. In this case, Christopher Herriot will inform the Customer by email.

A confirmation email summarising the details of the order to the Customer will be sent by Christopher Herriot. Consequently, the Customer accepts the single use of email for the confirmation of his order.

5. Price and terms of payment

5.1. Determination of the price

The prices of each product are net, excluding tax (VAT not applicable Article 293B of the CGI), in euros. Prices include shipping costs. They are reviewable at any time without notice.

Items are invoiced in euros based on the prices indicated on the site at the time of order. The total price of the order (products + free shipping costs) is indicated in the cart.

The Customer acknowledges that he is considered the official importer and that he may, depending on the country, pay any customs duties that will be borne by the recipient. These rights are not the responsibility of Christopher Herriot. 

5.2. Method of payment

The price is payable in cash, in full, on the day the order is placed by the customer, by secure payment, according to the following methods: by bank transfer or Paypal account.

5.3. The data recorded and kept by Christopher Herriot constitutes proof of the order and all transactions made. The data recorded by the payment system constitutes proof of financial transactions.

6. Delivery

Orders are shipped within two working days after receipt of payment. Any order placed from Friday to Sunday evening will be processed the following Monday or Tuesday.

Shipments to France are made by Colissimo. Delivery will be made in 48 hours or 72 hours, depending on the carrier chosen (these deadlines are purely informative and are not guaranteed).

All shipments outside France are made with tracking against signature.

As soon as your order is delivered to the carrier, Christopher Herriot cannot be held responsible for delivery times that may be long or irregular, or for possible deterioration of the products during transport.

Exceeding routeing times cannot give rise to deductions, damages or cancellation of a current order.

If your order has not been delivered within 30 days after shipment, and after noting the loss of the package, we offer to refund you. This can only be done after opening an investigation with the carrier who will confirm or not the loss of the package. The time to find the package can take 60 days.

In the event of damaged packages, the customer undertakes to notify the carrier and Christopher Herriot, via the contact form, of his reservations within 3 days of receipt of the package.

7. Right of withdrawal

The individual Customer has a right of withdrawal, which he can exercise without reason, within seven (7) clear days from the delivery of the order. He will return the unused products, in the state in which he received them, return costs at his expense.

8. Refund

Refunds of products in the cases of returns after withdrawal will be made by Christopher Herriot within a maximum of 30 days after receipt of the returned products. It will be done by the payment method chosen by the customer or no vouchers.

9. Intellectual property

The content of the Herriot Pipes website is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an offence of counterfeiting.

10.. Applicable law

Any question relating to these General Terms and Conditions of Sale and the sales they govern, which would not be dealt with by these contractual provisions, will be governed by French law to the exclusion of any other right. In the event of a dispute, the French courts will have sole jurisdiction.

11. Computer Science and Freedoms

Pursuant to Law 78-17 of 6 January 1978, it is recalled that the personal data requested from the Customer are necessary for the processing of his order and the establishment of invoices, in particular. The Customer has, in accordance with the national and European regulations, a right of permanent access, modification, rectification and opposition to information concerning him.
